Scope of this privacy notice

This Privacy Notice explains how Viasat collects, uses, discloses or otherwise processes your personal data when you use our websites and when we provide many of our services to you. We also explain your data protection rights as well as how to contact us if you have questions or comments.

Viasat collects your personal information when you interact with us.  We respect your privacy, and for this reason we work hard to gain and maintain your trust and to be transparent about how we use your information.  This Privacy Notice explains who we are, how we collect, use, and share your personal data and your related rights.

 

This Privacy Notice applies to the personal data that we collect when you visit the Viasat websites including when you sign up to any newsletters, download content, register for events or webinars (“Websites”); take part in competitions; purchase or use our residential, commercial, and community broadband connectivity, communications, content and analytics services; engage with our mobile applications (“Apps”); contact our customer support agents; receive and interact with the communications we send to you; or otherwise engage or communicate with us related to any of these services, or any other Viasat products or services that link to this Privacy Notice  (collectively referred to as the “Services”). 

 

We may provide these Services to you directly, such as when you sign up for our residential satellite broadband service.  You also may access certain Services because Viasat has a relationship with your company and we collect certain information about you as a result, including your user contact information and username and password credentials that enable you to access and use our Services, such as our Intelie by Viasat services.

 

IMPORTANT:  Viasat collects personal data for different reasons, not all of which are addressed in this Privacy Notice.  For example, the personal data processing for Viasat’s Mobility services, including our in-flight connectivity, maritime, and related services, is covered under a separate Privacy Notice.  Also, we collect personal data from you if you apply for employment with Viasat, and the processing of your information in this context is covered under a different Privacy Notice.  Our other privacy notices can be found in the Privacy Center on our Websites or at other locations where you interact with us.

 

Where we refer to “Viasat” (or “us,” “we,” or “our”) in this Privacy Notice, we mean Viasat, Inc., Inmarsat Global Limited and all of our group companies. To find information on the group company that is the owner of a particular Website or provider (or data controller) of a particular service, you can find a list of those entities here. Who we are and what we do

Viasat, including Inmarsat has been providing consumers, businesses and enterprises in the aviation, maritime, and other sections, and governments with communications and broadband internet products and services for more than 40 years.

Personal data we collect and sources of information

The personal data we collect either directly or indirectly from or about you will depend on the Service you are using and how you interact with us, and can include your contact, payment and service details, device information, websites you visit, cookies, and data captured using other tracking technologies.

When you interact with Viasat, we collect personal data about you from the following different sources:

  • Directly from you.  We collect personal data such as your name and contact information directly from you when you voluntarily choose to provide us with this information.
  • Indirectly.  We collect personal data about you indirectly, including through automated means.  Data we collect indirectly is captured through your use of the Services, and some information is collected using cookies and other tracking technologies, as explained further in the Cookies and Similar Tracking Technology section of this Notice.
  • Third parties.  We also collect information about you from third-party sources such as our business partners, as well as service providers that provide marketing, analytics, data (including advertising networks data), and financial and credit related services. Some of this collection may occur even before your initial interaction with us.

We use your personal data for various reasons, including to provide, support, and improve the Services and tailor the Services to you, to keep your information secure, and to communicate with you about the Services. We are a global company, and in certain countries and regions where we operate, we must inform you of our specific legal basis to collect and use your personal data.

We use the personal data that we collect from and about you only for the purposes described in this Privacy Notice or for purposes that we explain to you at the time we collect your information. 

Laws in certain locations where we operate require that we disclose our legal basis for processing your personal data, which includes the following bases depending on which service you use:

  • Contract – we require certain personal data to provide and support the Services you purchase or request from us
  • Consent – in certain circumstances, we may ask for your consent before we will collect, use, or disclose your personal data, in which case you can voluntarily choose to give or deny your consent without negative consequences to you
  • Legitimate Interests – we may use or disclose your personal data for the legitimate business interests of either Viasat or a third party, but only when we’re confident that your privacy rights will remain appropriately protected

If we rely on our (or a third party’s) legitimate interests to collect and use your personal data, these interests will normally be to operate and provide our Services, communicate with you and respond to your questions, improve our Services or use the insights to improve or develop new services, market or promote either our Services or the services of a third-party that are closely partnered with our Services, or to detect or prevent illegal activities.

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

When we share your personal data

Your information may be shared with third parties, such as service providers (within and outside the Viasat group) and business partners. On certain occasions where necessary or required, we may share your information with law enforcement, government agencies, or the purchasers of some or all of a Viasat group business.

We may disclose your personal data to the following categories of recipients to the extent permitted by applicable law:

  • Viasat group companies.  We share information across the Viasat and Inmarsat group companies to help us operate our business and Services or for their own purposes, such as to provide their services directly to you.  These entities are located in various countries around the world.  A list of countries in which Viasat entities are located can be found here. If a group company uses your information for its own purposes, those entities are ‘controllers’ (or a similar-meaning term) of your personal data. We sometimes may share information with group companies in an aggregated and anonymized format and in those cases, you will not be identified through the information that is disclosed.  Generally, all categories of the personal data that we process will be accessible to Viasat, Inc. 
  • Third-party service providers.  We use third-party vendors to perform services on our behalf.  These vendors provide business, professional, payment processing, marketing and advertising, analytics and measurement, and technical and hosting support to us, help us operate our business, Services, and Websites, and administer activities in support of our business and the Services on our behalf.  These vendors range from consulting services provided by groups and individuals, large technology platform and cloud hosting providers like Amazon Web Services, Salesforce, SAP, and others, and other third-party technology application providers.  These vendors are not permitted by us to use or share your personal data for either their own or another third party’s commercial purposes. These third parties are located in various countries around the world.
  • Credit agencies or bureaus.  We engage with credit agencies or bureaus to carry out credit checks so that we can make credit and solvency decisions when you request the Services. These credit agencies/bureaus are in various countries around the world.
  • Authorized retailers and distributors and delivery partners. We engage with select retailers that can help you select the best Service plan for you and support installation. You can search for our authorized retailers here and here.
  • Third-party ad platforms or networks.  We may also share personal data with advertising platforms or networks or permit these partners to collect information from you directly on the Websites to facilitate online advertising for Viasat services, such as search engines and social network advertising providers to serve ads for our Services to you or to groups of other users similar to you based on commercial interests and demographics, on third-party platforms or other websites you visit.   • Entities involved in corporate transaction.  We may sell or purchase assets during the normal course of our business.  In connection with these transactions, we may disclose your personal data or transfer this information to another entity as part of a potential or actual acquisition or merger of Viasat or any portion of our assets. If we bring or are defending a reorganization, bankruptcy, or similar event, your personal data may be considered our asset and sold or transferred to third parties. These third parties are located in various countries around the world. 
  • Law enforcement, governmental, judicial and related entities.  We may share your information to protect the security of our Services, network, and IT systems and applications, and business and in connection with an investigation of fraud, intellectual property infringements, interference with our rights, property or users, or other activity that is illegal or may expose you or us to legal liability, including as required or requested by outside auditors or advisors, law enforcement or other government officials.  We also may share your information with third parties when we have reason to believe that a disclosure is necessary to address potential or actual injury or interference with our rights, property, operations, users, or others who may be harmed or may suffer loss or damage. We may share your information when we believe that it is necessary to protect our rights, investigate, or enforce our policies, terms or other legal document or contract, or to comply with a judicial proceeding, court order, or legal process served on Viasat. We may share your data with public authorities such as tax authorities, to comply with our legal obligations.
  • Other persons with your consent to the disclosure.
  • Third parties who receive aggregate or anonymous information. We may share aggregate or anonymous information with third parties, including our business partners, for their business, marketing, or analytics uses. When we do, we take steps to ensure that this information cannot be used to identify you.
Cookies and similar tracking technology

Cookies are small data files that are placed on your computer or mobile device when you visit a website or online platform.  We use cookies and similar tracking technology (collectively, “Cookies”) to operate and enhance our Websites and certain Services and understand how you navigate our Websites and Services, to maintain user preferences or settings, combat fraud, help to ensure compliance with our policies and Terms of Use, and support our online advertising (including retargeting efforts) for Viasat services.  Where required by applicable law, we ask you to provide your consent to or give you choices on the use of these tracking technologies.

The measures we use are designed to provide a level of security appropriate to the risk of processing your personal data. No security system is 100% secure, however, and we cannot guarantee our security measures will not be compromised.;

International data transfers

We operate as a global organization with service providers and partners around the world. Your personal data may be transferred to countries with data protection standards that are not equal to the standards in the country where you are located. We put in place appropriate measures to safeguard your personal data when transferring it around the world.

Your personal data may be transferred to, and processed in, countries other than the country in which you reside.  These countries may have data protection laws that are different than the laws of your country (and, in some cases, may not be as protective).

 

The servers that operate or process personal data related to our Services are primarily located in the United States and the UK, though personal data also may be transferred to India, Israel, Ireland, and the group countries in which our business is established or our Services are available, and potentially other countries. Our group companies and third-party service providers and partners operate around the world. This means that when we collect your personal data, we or our service providers may process it in any of these countries. Please see under the heading "When We Share Your Personal Data" above for further information on third parties we may share your personal data with and in which countries they are located.

 

We take appropriate safeguards to help ensure that your personal data remains protected in accordance with this Privacy Notice. These include, for example, implementing the UK and European Commission’s Standard Contractual Clauses for transfers of personal data between our group companies, which require all group companies to protect personal data they process from the European Economic Area, Switzerland and the UK in accordance with data protection laws in those areas. Where appropriate, we also put in place additional safeguards to protect your personal data when it is transferred to countries considered to be less protective.

How long we keep your information

We will keep your personal data for as long as we have a legitimate business need to do so.

We retain the personal data we collect from you where we have an ongoing legitimate purpose to do so described in the “How We Use Your Personal Data and Our Legal Bases” section above. For example, where we process your information based on a contract with you, we generally will retain the information for the length of the contract to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

 

When we no longer have an ongoing legitimate business need to process your personal data, we will either delete or anonymize it or, if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.

 

Automated decision-making

We do not use your personal data to engage in automated decision-making that will have a significant effect on you (legally or otherwise).  In the U.S., we use automated tools that process information such as your location and credit history to assess whether our Services are an available or most appropriate service option for you and to inform the appropriate initial upfront fee for our Services.

Your choices and data protection rights

Depending on your location, you may have certain rights that you can exercise over our collection and use of your personal data.

Depending on your location, the privacy laws that apply to Viasat and our Services give you certain rights over the personal data we process about you.  These rights are in addition to your right to know or be informed about how we process your data, which we honor through our descriptions in this Privacy Notice.  Your data protection rights may include:

  • You can access, correct, update or request deletion of your personal data.  You also can object to processing of your personal data, ask us to restrict processing of your personal data or request portability of your personal data.  You can exercise these rights at any time by submitting a request through our online Privacy Rights Request Form.  You also have the right to avoid discrimination by us in response to exercising your rights.
  • You have the right to opt-out of marketing communications we send you at any time.  You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails you receive from us.  To opt-out of other forms of marketing (such as postal marketing or telemarketing), please contact us using the contact details provided under the “How to Contact Us” heading below.
  • If we have collected and process your personal data with your consent, then you can withdraw your consent at any time.  Withdrawing your consent will not affect the lawfulness of our processing activity prior to your withdrawal, nor will it affect our processing of your personal data conducted in reliance on lawful processing grounds other than consent.

Requests to exercise your data protection rights

Please submit a request using our Privacy Rights Request Form to exercise your data protection rights. While your location determines what rights are available to you, we respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

Requests to stop sending directed marketing

You can unsubscribe from marketing emails by clicking the unsubscribe link at the bottom of the email you receive from Viasat or its marketing partner. You also can use our Privacy Rights Request Form to instruct us to remove you from our marketing campaigns.

Account management

If you have set up an online account for Services that is accessible through one of our Websites or Apps you can manage your account settings by logging into your account.

For management of online accounts you have set up in connection with the Services, you can manage settings from within your account.

Accepting or rejecting Cookies

You can change cookie settings (including to decline non-essential cookies) by visiting our Cookie Notice or the Do Not Sell or Share my Personal Information page available on the Viasat Websites or Services you are using (where applicable based on local laws). You can also adjust your browser settings more generally and modify local device settings to accept or reject cookies. Personal data about children

Viasat Websites and Services are not intended to be used by children.  We do not intentionally collect children's data. 

The Viasat Websites and Services are not directed to children under 13 years old (or older, if applicable law provides for different protections), and we do not intentionally collect personal data from children. If you become aware that we have inadvertently collected personal data from a child, please notify us as soon as possible by contacting us using the contact details provided under the “How to Contact Us” heading below.

We may update this Privacy Notice from time to time in response to changing business, technical or legal developments.
